The K Haus LLC (“K Haus,” “we,” or “us”) respects your privacy and is committed to protecting it through our compliance with this Privacy Policy. This Privacy Policy describes the types of information we may collect from you when you visit thek.haus or use the K Haus mobile application (collectively, the “Site”), how we use the information we collect, with whom we share it, how we protect it, and the choices we offer you regarding our collection and use of such information. This Privacy Policy also explains your rights with respect to your personal information.

Types of Information We Collect

We receive and store any information you provide to us through the Site or otherwise (for example, if you contact us by telephone). This information may include your name, email address, physical address, telephone number and any other information provided or made available to us through your creation of an account, use of the Site or our services. Additionally, when you access the Site using a mobile device, we may collect and process real-time information about your location and your mobile device, including the unique identifier for your device. Most mobile devices allow you to turn location services off via the device’s settings menu.

The K Haus may enable you to access social networks through the Site. If you access a social network through the Site, your use of the social network is governed by such social network’s terms and conditions and privacy policies. If you access a social network through the Site, you may be asked to grant the K Haus access to certain information from your social network profile, such as your friends or contacts lists, photographs, and updates. This information may be used by the K Haus to suggest new features and content that may be relevant to you, for statistical analysis, or for other business purposes.

When you visit the Site, we may also collect certain information by automated means, such as cookies. A “cookie” is a text file that websites send to a visitor’s computer or other Internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. We may also use third-party website analytics tools (such as Google Analytics) that collect information about user traffic on the Site. The information we may collect by automated means may include, but is not limited to, the following:

information about the devices you use to access the Internet (such as the IP address and the type of the device, operating system, and web browser);

Information We Share

We may disclose aggregated, non-personal, information about our users without restriction. We may also disclose personal information to: (i) comply with any court order, law, or legal process, including to respond to any government or regulatory request; (ii) enforce or apply our Terms of Service and other agreements; and/or (iii) if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the K Haus, users of our Site, or others.

We also reserve the right to transfer personal information to a buyer or other transferee in the event of a merger, divestiture, restructuring, reorganization, dissolution, sale, or other transfer of some or all of our assets. Should such a sale, merger, or transfer occur, we will use reasonable efforts to direct the transferee to use personal information in a manner that is consistent with our Privacy Policy.

Payment Information

If you make a purchase on the Site, we will collect your credit or debit card number, expiration date, and other payment details (collectively, “Payment Information”). We may provide Payment Information and other personal information to our third party payment processors in order to complete purchases made on the Site. Pursuant to the “Information We Share” section above, our third party payment processors are bound by contractual obligations to keep such personal information confidential and use it only for the purposes for which we disclose it to them. However, we are not responsible for our third party payment processors’ use of any Payment Information or other personal information they collect in connection with your transactions on the Site.

Your Choices

We offer you the following choices about what information we collect from you and how we communicate with you:

Cookies. Most browsers will tell you how to stop accepting new cookies, how to be notified when you receive a new cookie, and how to disable existing cookies. Please note, however, that without cookies you may not be able to take full advantage of all of the Site’s features.

Marketing Emails. If we have sent you a marketing email, you may choose not to receive additional marketing emails from us by following the unsubscribe instructions contained in each email.

Location and Social Media Information. You can restrict the K Haus’s collection and use of real-time information about your mobile device’s location through your device’s privacy settings. You can restrict the K Haus’s access to your social network profile at any time by changing your social network privacy settings.

Web Analytics. You may opt-out of the aggregation and analysis of data collected about you on our Site by our web analytics vendor by visiting https://tools.google.com/dlpage/gaoptout and downloading and installing the Google Analytics Opt-out Browser Add-on.

Accessing and Correcting Your Information

You can review and change personal information you disclose to us by logging into the Site and visiting your account profile page. If you provide us with personally identifiable information, you have the following rights with respect to that information:

  • To review the personally identifiable information that you have supplied to us;
  • To request that we correct any errors, outdated information or omissions in the personally identifiable information that you have supplied to us;
  • To request that your personally identifiable information not be used to contact you;
  • To request that your personally identifiable information be removed from any solicitation list that we use;
  • To request that your personally identifiable information be deleted from our records; and
  • To opt out of being solicited by the Site.

If you request that your personally identifiable information be deleted from our records, there may be a brief delay in our processing that request while we verify that the request is valid and originates from you as opposed to an unauthorized third party. If you request that your personally identifiable information be deleted, we reserve the right to terminate and/or limit your access to the Site.

Security

The K Haus has reasonable security measures in place in an effort to protect personal information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please note that no electronic transmission of information can be entirely secure. We cannot guarantee that the security measures we have in place will never be defeated or fail, or that such measures will always be sufficient or effective. Any transmission of information is at your own risk. We are not responsible for circumvention of any Site privacy settings or our security measures.

Geographic Restrictions

The K Haus is based in and operates the Site out of the United States. When we obtain personal information about or from you, we may process such information outside of the country in which you are located, including in the United States. The countries in which we process personal information may not have the same data protection laws as the country in which you are located. We will protect personal information you disclose to us as described in this Privacy Policy.

Children Under the Age of 13

The Site is not directed to, and the K Haus does not knowingly collect or solicit personal information from or about, children under the age of 13. If we learn we have collected or received personal information from or about a child under the age of 13, we will delete that information. Changes to Our Privacy Policy

The K Haus reserves the right to update or change this Privacy Policy at any time. If we make a material change to our Privacy Policy, we will indicate on the Site that our privacy practices have changed and will provide a link to the new policy. In the event we make a material change to how we use personal information you disclose to us, we will provide you with an opportunity to opt out of such new or different use. The date this Privacy Policy was last revised is at the top of this page. You are responsible for periodically reviewing the Site and this Privacy Policy to check for any updates or changes.

For your safety and those around you, to enter our facility, you need to be fully vaccinated.

All members and guests age 12 and older are required to provide proof of complete vaccination. People are considered fully vaccinated: 2 weeks after their second dose in a 2-dose series, such as the Pfizer or Moderna vaccines, or 2 weeks after a single-dose vaccine, such as Johnson & Johnson's vaccine.

Proof of Vaccination includes:

• Physical Vaccination Card

• New York State Excelsior Pass​

• CLEAR Digital Vaccine Card

• Canadian Vaccination Receipt

• Digital Vaccine Verification issued by states outside of NYS

Photos of vaccine cards will not be accepted.

Children under the age of 5 are required to wear masks.
